Unless something has changed recently, there isn't a test to determine if you are still under the influence of marijuana. So testing positive for use doesn't mean you are impaired.
They shine the flashlight into your eyes, and if the spliff is still smoldering…. You’re up the creek…without a paddle. Driving while stoned is a DUI violation.
its just the passenger using--really...my former neighbor, a newark Firefighter smokes heavily...i was a few hundred feet from his car when he opened the door and the stench hit me when he opened the door....
I used to LOVE driving while high. Particularly on long trips.

Two stories....
1) I was walking along Dunnell across from the Parc Apartments and there were three young men sitting in a late model Accord smoking quite a bit. As I walked by, they rolled up the windows to stop the smoke from going my way.
2) I was driving through a neighboring town earlier this week and I came up behind a car driving very slowly, about 5-10 mph. I followed it for about two blocks and they never when over 15 mph. The smell of weed coming from that car was very strong. As soon as I turned down a different street, the smell disappeared.
I remember driving my car down a long country road as a college student after smoking some weed, when I suddenly saw lions and tigers approaching from either side of the street, for several miles Fortunately, I was able to reach my destination without a scratch.
Maybe around 1980 and it was around 1 a.m., after a night of hot sex and Panamanian Red. I was driving past Bryant's Pond in Summit. There were no other cars on the road.
For some reason, I stopped the car in the lane --- then I realized there was no reason why I should have stopped so I continued on my merry way, back to Mapleood.
I was in Eagle Rock Reservation the other day. A not-young couple got out of their car to smoke a joint. I see (smell) people smoking there in their cars every time I go, but it surprised me that they were just standing out in the open lighting up.

I believe that smoking anything is a misdemeanor offense in any public park or beach in N.J.
I'm in Manhattan pretty often and smell weed everywhere, coming from all kinds of people. I find it amusing.
I wonder if public intoxication/consumption laws will be modified to cover weed usage in public spaces. Right now there seems to be a few folks adopting an attitude of “yay pot is legal I can smoke it anywhere now!”
And clearly driving while stoned should be prohibited and prosecuted the same as driving intoxicated.

There are more dispensaries than there are liquor stores at this point. In the outer boroughs, even the bodegas have a menu of cannabis available to purchase.

I don't understand what the surprise is. It's legal in New York. Is it not legal in New Jersey yet?
It seems I smell the smoke on every block in NYC and at all hours of the day.

it's still illegal to smoke out in the open in NJ, unless it's an area that's marked for smoking.
As someone who has been smoking weed, sneaking, hiding, slinking, creeping, etc. for, let's just say half a century, it's liberating to have the constraints (mostly) disappear. I apologize if the smell is annoying, but freedom has finally come (sort of) to the masses of stoners. You'd be amazed how many, among your friends and peers, are vaping marijuana and doing edibles.

Why does marijuana nowadays smell like skunk droppings? I remember smoking in the 70’s and the smell of Colombian gold was totally different… seeds and all popping…

Yes and no. We old timers enjoy the act of cleaning, rolling the joint, filling the pipe, passing the joint, etc. Vapes and edibles are a different experience and a slightly different high. For me, generally speaking, it's leaf at home and vape out and about.

I don't think that it does. The weed today is many, many times stronger than the $20/oz Mexican scratch that we bought and smoked in college (early 70s). Some of it is dangerously strong. But the smell, as far as this allergically challenged sniffer can tell, is pretty much the same. (And how do you know what skunk droppings smell like?)

I haven't tried a vape I like, though I've only tried two or three. They're expensive, and I couldn't get them to work. I'd love one that works. I'd like not to haul hot smoke in my lungs.
Edibles are a nice idea, very convenient, but the effect comes after a long and unknown delay.
I might be more sensitive than before, and today's weed is so much more potent that I only take one draw, and I'm done. And sometimes that's too much. I'd love to have more control.

I get my vape carts in Michigan and I think they're pretty cheap. Don't know what NY/NJ prices are, but my last purchase was 3 carts for $25, on sale. Which is kind of ridiculous seeing as I only need a few puffs to get high for a few hours. One cart will last months for me.
I'm a little wary of edibles as of late. I was doing ok until last summer, when I tried a new brand. It was a 10mg gummy. My previous brand was also 10mg, and I used to cut it in half and that worked out OK. With the new brand I also cut it in half. This was my 2nd or 3rd try of the newer brand. It literally put me on my ****. I was in a chair one minute, and the next thing I remember was looking up from the floor at my brother, who was trying to figure out why I was on the floor. He helped me to a couch, where I sat for two hours until I felt steady enough to walk.
Haven't touched an edible since then. I think there may be some quality control issues pertaining to dosage consistency. Much easier to regulate the dose with a vape.

It seems so many places I go around here when I park my car and walk through the parking lot I see and smell people sitting in their cars smoking weed. Now I don't care what people do, but aren't they asking for trouble? When they get pulled over for speeding or something else inconsequential doesn't the officer smell the weed infused in the vehicle fabric and take them in for DUI? Isn't that essentially the same as open container? And since weed stays in your blood for a while, wouldn't they test positive?
